Our applications are operated by Aymor Applis, a sole proprietorship registered in Québec, Canada. To reach us: aymorcorp@gmail.com.
Most of our applications are sold to businesses, to be used within their own business. By buying them, you confirm that you are using them for your own business, and not as a consumer.
Aymor Cuisine is an application for individuals. If you buy it for personal use, you are a consumer, and sections 6 and 7 say so expressly.
Each application describes what it does on its own page. None of our applications replaces a professional: they do not run payroll, do not calculate or withhold tax, and do not replace the review of an accountant, a payroll professional or an adviser. Checking the calculations before you use them is yours to do.
The price of your subscription is shown to you before you pay, and that is the one you accept. The price in force is always on the prices page and on the purchase screen.
A period already paid for does not change price. Prices can change; if they do, you are told at least 30 days before the new price is charged to you.
The App Store sells only at its own price tiers. The price you see when buying there may differ slightly from the one on our page, and that is the one that applies to that purchase.
You can cancel at any time from your account in our store or in the Paddle portal: the link is in your receipt email. After you cancel, the following period is not charged to you, and you keep full access until the last day of the period you already paid for.
Amounts already charged are not refunded, unless the law where you live requires it. Paddle, which processes the payment and acts as the authorized reseller, applies its own refund policy (paddle.com/legal/refund-policy). To request a refund from Paddle, go to paddle.net (the link is in your receipt email). If you bought on the App Store, Apple decides and processes the refund under its own rules. If you have a problem with the application, write to us at aymorcorp@gmail.com.
Our applications are provided "as is" and "as available". To the extent permitted by law, we do not warrant that they will run without interruption or error, nor that they will suit a use other than the one announced. If you buy as a consumer, the legal warranty provided by law applies despite the above.
If you use an application for your business: Aymor Applis's total liability to you, for any claim related to an application, does not exceed the total you paid Aymor Applis for that application in the 12 months before the claim. Aymor Applis is not liable for indirect, incidental, special or punitive damages, nor for lost profits or lost revenue.
If you buy as a consumer: this limit does not apply to you. No liability cap is held against you, and no clause of these terms takes away the rights that Quebec's Consumer Protection Act gives you, or the legal warranty.
Nothing in this section is intended to exclude Aymor Applis's liability for intentional fault or gross fault, or to break the essential balance of the contract under article 1437 of the Civil Code of Québec. If any part of this section were found abusive under that article, it applies only to the extent permitted, without invalidating the rest of the contract.
Your subscription is for your own use or your business's use. You may not resell it, redistribute it, or share your access with other businesses without our written permission.
What each application keeps, and where, is described in its own privacy policy. Aymor Applis's general privacy policy explains what this site collects. If they differ, the application's own policy applies to that application.
How we give notice of a data breach is described in each application's privacy policy.
These terms are governed by the laws of Quebec, and any disagreement is settled by the courts of Quebec. No clause may be abusive to the point of breaking the fundamental balance of the contract (article 1437 of the Civil Code of Québec); that protection applies even if you are not a consumer under the consumer protection act.
If you buy as a consumer and live in Quebec, you may bring any claim before the courts of Quebec; if you live outside Quebec, the mandatory laws of where you live continue to protect you. Nothing here requires you to go to arbitration or takes away your right to a class action.
The terms you accepted when you bought are the ones that apply to that purchase. If they change, the change applies only to future purchases. A change that increases what you pay or reduces what you receive in a subscription already running applies only if we tell you in writing at least 30 days ahead and you may refuse it and cancel at no cost or penalty.
These terms are offered in French, English and Spanish, and they say the same thing in all three languages. You can read the French version before you accept. If there is a difference between the versions, the French version prevails.
